Terms of Service

These Terms govern your use of Old Photo Restoration(the "Service"), operated by Zhmaka Commerce. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service and to make a purchase.

2. Your photos and your rights

You keep all ownership of the photos you upload and of the restored results. You confirm that you own the photo or have permission to upload and restore it, and that doing so does not violate anyone's rights. You must not upload unlawful, infringing, or non-consensual content.

3. License you grant us

To provide the Service, you grant us a limited license to store, process, and transmit your uploaded photo through our AI providers and to deliver the restored result to you. In addition, you agree that we may retain and use restored outputs — including results you rejected, did not purchase, or that failed our quality checks — and, where necessary, the corresponding uploaded photo, to analyze, debug, test, train, and improve the Service. This use is described further in our Privacy Policy, and you may object as described there.

4. The result is an AI reconstruction

Restoration is performed by artificial intelligence. The result is a best-effort reconstruction, not a forensically exact copy. In particular, a black-and-white or faded original does not record true colors, so eye color, hair color, and other tones are the AI's natural estimate and may differ from reality. We do not guarantee that the output will match your expectations or the subject's exact appearance.

5. Payment and refunds

The price for a full-resolution restored file is $24 (USD), charged through Stripe. Because the result is generated and shown to you before purchase, sales are final. However, if processing fails or you are charged in error, contact us at alexzhmaka250219@gmail.com and we will make it right.

6. Acceptable use

You agree not to abuse the Service, including automated or bulk uploads, attempts to bypass upload limits, or uploading content that is illegal or harmful. We may limit, suspend, or refuse service to protect the Service and our providers.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us for the restoration in question. We are not liable for indirect, incidental, or consequential damages.

9. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules.
