This Privacy Policy explains how Zhmaka Commerce("we", "us") collects, uses, and protects your information when you use Old Photo Restoration(the "Service"). We are the data controller. For any privacy request, contact us at alexzhmaka250219@gmail.com.

1. Information we collect

• Photos you upload and the restored versions we generate from them.
• Email address, which you provide before processing so we can deliver your result.
• Payment information, handled entirely by Stripe. We never see or store your card number — we only receive confirmation that a payment succeeded.
• Technical and usage data — IP address, device and browser type, and interactions with the site — used for security, abuse prevention (upload limits), and analytics.

2. How and why we use your data (legal bases under GDPR)

• To restore your photo and deliver the result — performance of a contract (Art. 6(1)(b)).
• To send your result and receipt by email — contract.
• To prevent fraud and abuse, secure the Service, and to analyze, debug and improve our restoration quality (see Section 4) — legitimate interests (Art. 6(1)(f)).
• For advertising measurement (e.g. Meta Pixel) — consent, which you can decline via the cookie banner.

3. Who we share data with

We use trusted processors that act on our instructions: Replicate (AI processing), Cloudflare R2 (file storage), Stripe (payments), Resend (email delivery), Neon (database), Vercel (hosting), and Meta (advertising measurement, only with your consent). Some of these providers are located in the United States; such transfers are covered by Standard Contractual Clauses or equivalent safeguards. We do not sell your personal information.

4. Using results to improve the Service

Restoration is powered by AI, and quality varies. To keep improving, we may retain and use restored outputs — including results you rejected, did not purchase, or that failed our quality checks — and, where necessary, the corresponding uploaded photo, for internal analysis, debugging, quality assurance, and model improvement. This is based on our legitimate interest in providing a reliable Service. You can object at any time by emailing alexzhmaka250219@gmail.com, and we will stop and delete the relevant material.

5. Retention

Your full-resolution restored file is stored for 30 days, after which it is automatically deleted. Order and transaction records are kept as long as required for tax, accounting, and legal purposes. Material retained under Section 4 is kept only as long as needed for that purpose.

6. Your rights (GDPR / EEA & UK)

You have the right to access, rectify, erase, restrict, and port your data, to object to processing based on legitimate interests, and to withdraw consent at any time. To exercise any right, email alexzhmaka250219@gmail.com. You also have the right to lodge a complaint with your local data protection authority.

7. Your rights (California — CCPA/CPRA)

If you are a California resident, you have the right to know, delete, and correct the personal information we hold about you, and to be free from discrimination for exercising these rights. In the past 12 months we collected the categories described in Section 1 (identifiers, photo content, internet activity, commercial information).

We do not sellpersonal information for money. If you consent to advertising cookies such as the Meta Pixel, that may be considered "sharing" for cross-context behavioral advertising under the CPRA. You can opt out at any time via our cookie banner or by emailing us — this is our "Do Not Sell or Share My Personal Information" mechanism.

8. Children

The Service is not directed to children under 16, and we do not knowingly collect their personal information. You may upload photos that include children only if you are their parent/guardian or are otherwise authorized to do so.

9. Security

Files are transferred over encrypted connections and stored with access controls. No method of transmission or storage is completely secure, but we take reasonable measures to protect your data.
